The following terms and conditions apply to all users of www.durance.co.nz and to all purchases of goods from Durance New Zealand.
The contents of the website are the copyright of Durance New Zealand. No part of the website may be distributed or copied for any commercial purpose and you may not incorporate any part of it in any other work.
www.durance.co.nz makes information and material available to you as a service. Use of the website material is at your own risk. We are not responsible for any adverse consequences arising out of the use of information contained on the website. We do not give any warranty of accuracy or reliability of information contained on the website to you or any other person.
Limitation of Liability:
Our liability for any claim, damages, loss, or expense related to the supply by www.durance.co.nz of goods or services, is limited to the cost paid by you for the goods or services and except where statute expressly requires otherwise. To the fullest extent permitted by law we will not be liable in any event for any loss of profits or any consequential, indirect or special damage, loss or injury of any kind suffered by you or any other person.
The Consumer Guarantees Act sets out minimum standards for goods sold by www.durance.co.nz. In the event that goods sold are not of good quality or are faulty, we have the right to repair, replace or a refund you for the product. If you feel this is the case, please contact us at email@example.com.
Durance New Zealand makes every effort to provide detailed descriptions and quality photography of all products. As a result we do not accept returns except where the basis of the return is covered by the Consumers Guarantees Act or Fair Trading Act. So when you are selecting and finalising the purchase of your products please take time to do so thoroughly.
Where goods are advertised with reference to a photograph, we cannot guarantee that your monitor's display of any colour will be accurate. We will endeavour to deliver the corresponding goods but do not warrant that the goods we deliver to you will be identical to those displayed in the photograph or on your monitor.
All prices on www.durance.co.nz are stated in New Zealand Dollars and include GST. We may alter prices without notice.
On receipt of a purchase order we will endeavour to supply you with the goods but we will not be liable to any person if we decline to fulfil, or are unable to fulfil, an order.
The contents of www.durance.co.nz may include links to third party materials. We will not be responsible for the contents of any linked site or liable for any direct or indirect loss or damage suffered by you from accessing, using, relying on or trading with third parties. These links are provided to you only as a convenience, and the inclusion of any link does not imply our endorsement of the site or any association with their operators.
Durance purchases should reach addresses within 2-4 working days. Please allow for up to 5 working days for deliveries to rural areas. You may contact firstname.lastname@example.org should you wish to query or track your item if it has not been delivered within the specified time period.
Terms & Conditions of the Durance Loyalty Programme:
DURANCE Rewards is a loyalty programme offered by DURANCE to its online customers (also referred to as “the Programme”). These terms and conditions form the agreement (the “Agreement”) between each customer that participates in DURANCE Rewards (referred to as a “Member”) and DURANCE (“Company”) with respect to the programme.

By participating in DURANCE Rewards, each Member agrees to the terms and conditions, rules, regulations, policies, and procedures of the programme.
Each Member is responsible for remaining knowledgeable about the programme terms and conditions. DURANCE reserves the right to disqualify and ‘black-list’ Members who have violated any of the Programme terms and conditions.
DURANCE reserves the right to change the terms or conditions of the Programme or terminate the Programme at any time without prior written notice.
Communications about DURANCE Rewards, including changes to the Programme, will be posted here and communicated in the regular DURANCE marketing email to all Members and people on the Programme database.
DURANCE Rewards is open to New Zealand residents at least 18 years of age.
Programme membership is only available to individuals, Programme membership will not be available to corporations, businesses, charities, partnerships, enterprises, or any other entity, unless written approval is received in advance from DURANCE, in its sole discretion.
Member is responsible and liable for any tax consequences which may result from Member’s participation in the Programme.
Membership in the Programme is free and no initial purchase is required.
DURANCE reserves the right to refuse issuance of a DURANCE Rewards account to any customer who does not follow the enrollment procedures. Member should notify the Programme of any changes to Personal Information such as name, address, telephone numbers, and email address either by logging into their online account, or by visiting the DURANCE store (please note identification may be required). Changes cannot be made over the telephone.
DURANCE reserves the right to cancel any DURANCE Rewards account for which it has incomplete, inaccurate, false or fictitious Personal Information and all DURANCE Rewards points earned on that account will be forfeited. The account enables the Member of DURANCE Rewards to access sales and promotional pricing, earn DURANCE Rewards points on certain purchases or behaviors (“Points”) and redeem Points on certain future purchases at DURANCE online.
Member must provide his/her phone number associated with the DURANCE Rewards account or present his/her photo identification to the cashier in-store before the purchase transaction is completed in order to earn and/or redeem Points.
Points have no fixed value, may not be redeemed for cash, and are not transferable to any other individual or entity. Any transfer or attempt to transfer Member’s Points shall result in automatic cancellation of the account and revocation of Member’s Points.
Fraudulent and/or unauthorized use of rewards coupon codes by individuals who have not earned the level of reward through their shopping history is strictly prohibited, and may result in termination or disqualification from the Programme.
DURANCE Rewards Members may be offered promotions (“Point Promotions”) which will award Points with the purchase of specified products and/or services during the promotion period.
Point Promotions will not apply to rain check items purchased after the promotion has ended.
DURANCE Rewards Members will earn 1 point per $1 spent in-store or online, unless specified as Double Points (2 points per $1 spent) or Bonus Points (as defined at the time).
DURANCE reserves the right to add or delete items eligible for Points issuance at any time, at its sole discretion, without notice.
All Points will be awarded to the Member’s account at the time of purchase.
In the case of a return and/or exchanged item, the Points will be deducted from the Member’s account.
From time to time, other incentive Programmes or product specials may be combined with DURANCE Rewards and these Programmes may offer incentives that can be accumulated on your DURANCE Reward account.
When purchasing items the Member may choose to either redeem earned Points or continue saving Points to use on a future purchase of products from DURANCE. If the Member elects to redeem earned Points, the Points will be converted into the value of the reward and the redemption points will be deducted from the total price of the Member’s purchase of items and/or services.
Earned Points are converted into rewards in 5 core tiers:
- 150 points = $15 reward
- 300 points = $60 reward
- 600 points = $90 reward
- 800 points = $150 reward
- 1,000 points = $200 reward
An initial reward of 50 POINTS will be awarded upon joining the Programme.
DURANCE may, at any time and without notice, change, eliminate, or terminate the Point earning and redemption procedures and offerings and at its discretion, may not show the full list of redemption tiers on marketing materials.
Upon redemption of Points, the Points will immediately be deducted from Member’s account.
Once Points are redeemed, Points cannot be credited back to Member’s account.
The sale or barter of Points, or any other award or benefit (other than by the Company) is expressly prohibited. Any Points, award, or benefit transferred,
assigned, or sold in violation of the terms and conditions will be confiscated and
membership in the Programme may be terminated.
DURANCE Rewards Points do not have an expiry, but DURANCE reserves the right to suspend, inactivate or close Member accounts at their discretion after 12 calendar months of inactivity with all accumulated Points being forfeited.
Member Information & Communications:
By participating in the Programme, Member agrees to allow Company to communicate via mail, email, phone and other channels. If permission is granted by the Member, Company may also communicate via text or mobile device.
Company may use these channels to communicate the Member account status, notify Member when they are eligible for a reward, communicate Programme changes, and offer special Member promotions, coupons and more.
Member information will be protected in accordance with the Online Privacy and
Security policy and/or the Notice of Privacy Practices, as applicable.
